1. Introduction

These Terms of Service ("Terms") govern your use of the OfferSmart website and services (the "Service"), operated by OfferSmart ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you should not use the Service.

2. Description of Service

OfferSmart is a UK-based web platform that generates property buyer reports. Users may paste a property listing link from supported portals (such as Rightmove or OnTheMarket) or enter a property address to generate a report. Reports analyse comparable sales, market trends, environmental data, and other property insights using publicly available datasets and third-party APIs.

3. Nature of the Report

The OfferSmart report is a data-driven buyer insight tool designed to help prospective property buyers make more informed decisions. It is important to understand the following:

The report is not a RICS valuation. It is not prepared by a chartered surveyor and does not meet the standards of a formal Royal Institution of Chartered Surveyors (RICS) valuation.
The report does not replace professional advice. It should not be used as a substitute for professional financial, mortgage, legal, or surveying advice.
Valuations and projections are estimates only. All property valuations, price projections, and market forecasts contained in the report are indicative estimates based on available data. They are not guarantees of actual market value or future performance.
The report does not replace a physical survey. A report generated by OfferSmart cannot assess the physical condition of a property. Buyers should always commission an appropriate survey before purchasing a property.

4. Data Sources and Accuracy

OfferSmart reports are compiled using publicly available data sources including, but not limited to:

HM Land Registry Price Paid Data
Office for National Statistics (ONS)
UK Police crime statistics
Planning application data from UK planning portals
PropertyData market datasets
Google Places API

While we make every effort to ensure the accuracy and reliability of the data presented, we do not warrant that the information in any report is complete, accurate, or up to date. Data may contain errors, omissions, or delays inherent in the original source material.

Third-party data providers operate independently of OfferSmart and we are not responsible for the accuracy or availability of their data.

5. Use of AI

OfferSmart may use artificial intelligence models to generate property insight summaries, risk assessments, and analysis within reports. AI-generated content is provided for informational purposes only and should be independently verified.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to reverse-engineer, scrape, or systematically extract data from the platform
Use automated tools, bots, or scripts to access the Service without our prior written consent
Resell, redistribute, or commercially exploit OfferSmart reports without authorisation
Interfere with or disrupt the operation of the Service

We reserve the right to suspend or terminate access to any user who violates these Terms.

7. Payments and Refund Policy

All payments are processed securely through Stripe. OfferSmart does not store or have access to your payment card details.

Refund Policy: OfferSmart reports are digital products that are generated and delivered instantly upon purchase. As such, all purchases are non-refundable once the report has been delivered. By completing a purchase, you acknowledge and accept that you are purchasing a digital product for immediate delivery and waive any right to a cooling-off period under the Consumer Contracts Regulations 2013.

8. Limitation of Liability

To the maximum extent permitted by law:

OfferSmart provides the Service and all reports on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
We do not accept liability for any loss, damage, or expense arising from the use of, or reliance upon, any information contained in an OfferSmart report.
We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profit, loss of data, or loss of opportunity.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount paid by you for the specific report giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

9. Intellectual Property

All content, branding, design, and software associated with the OfferSmart platform are the intellectual property of OfferSmart. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

Reports purchased by users are licensed for personal use only and may not be commercially redistributed.

10. Third-Party Services

The Service integrates with third-party providers including Stripe, Google, PropertyData, and others. These services are governed by their own terms and conditions. OfferSmart is not responsible for the availability, accuracy, or conduct of any third-party service.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of the Service after any changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
